Abstract

The purpose of this study is to uncover the factors underlying the use of probono legal aid legal aid services in the Class 1A Religious Court of Tanjung Karang, Bandar Lampung City. This research is a field research (field research), primary data taken from service users, service managers and officials in the Class 1A Religious Court of Tanjung Karang in Bandar Lampung City, through structured free interviews. This research found the fact that the presence of Legal Aid Posts which provide probono legal aid services is very helpful for people who need legal assistance because of their limitations with the factors that become the reasons for using legal aid services for probono legal aid. For those who do not understand the law, the presence of Posbakum in the Class 1A Religious Court of Bandar Lampung City is very helpful in the process of resolving legal issues, as well as for those who do not have sufficient budget and funds to resolve legal issues that are being passed through, the presence of Posbakum is very helpful and reduce their financial expenses. The presence of Posbakum also facilitates and accelerates the resolution of legal issues.

Abstract

This research is motivated by the practice of profit sharing in the management of land by cooperatives in the absence of time clarity in the distribution of results carried out by cooperatives to their members. Islam towards the practice of sharing the results of land management by the Cempaka Biru Cooperative in the Sejangkung District. This type of research is a type of descriptive qualitative research that is Field Research (field research). The study uses a normative sociological approach. The data source in this study uses primary data taken from the cooperative chairman, treasurer and cooperative members. Whereas the secondary data sources are books, mass media and the Law. Data collection techniques used were observation techniques, interview techniques, and documentation techniques. Based on the results of the study, the researchers concluded that the practice of sharing the results of land management by the Cempaka Biru Cooperative did not violate Law No. 25 of 1992 article 45 concerning Remaining Results of Operations, because basically the residual results of cooperative efforts are cooperative income obtained in one fiscal year. In the analysis according to the perspective of Islamic law the profit-sharing in the Cempaka Biru Cooperative is called the profit sharing of the Musaqah plantation estate or mukhabarah. But the practice of sharing the results of land management by the Cempaka Biru Cooperative in the District of Sejangkung is prohibited by syara 'because of the existence of a contract containing the element of gharar (uncertainty) so that it is prohibited by syara'.

Abstract

The purpose of this research is to know the factors that cause the Muslims in Bunut village west Kisaran District Asahan Regency to do polyandry practice. The process of a wife’s marriage is still valid marriage to her first husband. Wives get married to other man without any divorced or divorce proceedings because the wife is separated form the first husband. This research is a field study, researchers use qualitative debitor that use the interview method as primary data which then generates descriptive analytical data. Results of this research, after conducting the factors are influenced by economic factors, low levels of education, and lack of awareness of people's understanding of the law, the first husband is not responsible, the husband's work away from his wife, polygamy husband, high lust, and weak supervision of the Office of Religious Affairs (KUA) when the parties get married husband and wife. Regarding public awareness in Bunut about marriage belong is low so that they does not follow the rules in Islamic law, marriage law and compilation of Islamic law.

Abstract

This study seeks to explore the possibility of implementing eclectic-pragmatic reasoning in the DSN-MUI fatwa on Sharia Banking Products. By applying the Ahmed Fekry Ibrahim study model when exploring the eclectic-pragmatic tradition of Islamic law. This study finally succeeded in introducing a thesis that the DSN-MUI fatwa, especially related to Islamic banking products, is full of eclectic-pragmatic reasoning.  This is also expected to be the novelty of this study. Because previous studies, such as those conducted by Ahmed Fekry Ibrahim did not specifically discuss the eclecticism of Islamic law on the fatwa products of the Indonesian Ulema Council related to Islamic banking products. This can be identified from two things, namely: First, the eclectic-pragmatic reasoning of the DSN MUI Fatwa on Islamic banking products can be traced from the selection of legal arguments that are consistent in primary arguments, but flexible in choosing secondary arguments - the views of cleric. Second, the principle of protection of corporate needs, in this case encouraging the banking industry to respond to market needs, so that fatwas are made in the framework of these interests.

Abstract

This paper aims to describe Takhrij as a medium for understanding the general rules established by imams that are built on the fiqh fiqh by induction and analyzing specific problems (furu 'fiqhiyah), this is what the takhrij ushul means for furu'.Takhrij also means to resolve differences furu 'fiqhiyah with the ushuliyah rules originating from the imams. It is expected to find a law that does not have the proposition shara 'by returning it to the rules and ushul. With a literature study and comparative approach to descriptive analysis, it is found that fiqh takhrij is also used to recognize the law that comes from a priest in a problem that has no text. Its can be made by comparing it with the same furu 'problem with the texts (qiyas), or comparing it with the understanding of Imam's texts or its generality. This is the furu takrij 'on furu'. Takhrij fiqh can be applied to contemporary problems such as loading and unloading insurance, inflation, copyright, furu 'and Syariah laws' in contemporary matters. The development of takhrij fiqh is dependent on the interaction of theory and practice in the existing field to produce solutions to contemporary problems.

Abstract

Indonesia has written law in the form of positive law and law that lives in recognized societies and then becomes customary law, but recognition of customary law applies only to groups that recognize its existence, of course this is contrary to positive law that applies universally. Here the author tries to examine how the role of customary law in the formation of positive law and what its effects. The method used in this paper is a qualitative method and the approach uses library research. As a rule of law aimed at creating harmony and balance in society, the existence of customary law in a rule of law is absolutely necessary, because the rule of law as a feature of the rule of law is not a final word, but as a way to create justice in society.

Abstract

Dalam fikih Islam kasus suami menuduh isterinya melakukan zina disebut Qażfu al-Zina. Jika terjadi hal seperti itu − menurut Alquran − langkah-langkah yang harus ditempuh untuk menyelesaikan masalah tersebut ialah dengan menyuruh suami mendatangkan saksi empat orang. Jika ia tak bisa mendatangkan saksi sebanyak itu, ia harus bersumpah atas nama Allah sebanyak empat kali yang menyatakan bahwa tuduhannya itu benar, bukan fitnah. Setelah itu ia harus mengucapkan sumpah sekali lagi (yang kelima) di mana ia harus mengatakan bahwa laknat Allah akan menimpa dirinya jika tuduhannya itu tidak benar (palsu). Setelah suami mengucapkan sumpah demikian, ia terbebas dari hukuman menuduh berzina, yakni didera atau cambuk 80 kali. Adapun isteri yang dituduh berbuat zina, ia harus dijatuhi hukuman rajam jika ia tidak menyangkal sumpah suaminya. Tetapi jika ia bersumpah empat kali menyangkal kebenaran sumpah suaminya, dan ia bersumpah yang kelima dengan menyatakan bahwa laknat Allah akan menimpa dirinya jika tuduhan suaminya itu benar, maka ia terbebas dari hukuman. Sumpah mereka disebut sumpah li’an, dan perempuan tersebut dinamakan mula'anah. Akibat sumpah li’an ini hubungan perkawinan keduanya putus selamanya. Jika isteri dalam keadaan hamil, anak yang akan dilahirkan nanti hanya punya hubungan dengan ibunya. Dalam kehidupan masyarakat seringkali terjadi isteri yang menuduh suaminya berbuat zina. Maka dalam penelitian ini, penulis akan menelusuri bagaimana langkah-langkah menyelesaikan kasus itu dan bagaimana akibat hokum dari tuduhan itu. Penulis juga akan menjelaskan mengapa Alquran mengharuskan dengan adanya empat orang saksi dan bagaimana dengan hukuman zina yang tidak bisa dijalankan karena hokum yang berlaku bukan hokum Islam. Apakah istighfar saja sudah cukup sebagai pengganti hukuman. Hal-hal tersebut penulis deskripsikan secara mendalam dengan menggunakan dalil naqli maupun aqli. Dari berbagai argument yang penulis dapatkan, penulis berkesimpulan bahwa sekalipun ayat yang berkenaan dengan hukuman zina itu bersifat jelas, tidak mengandung keraguan (qath'i), tetapi masih ada ruang untuk tidak menerapkan had sebagaimana yang ada dalam Alquran dan berpindah kepada bentuk hukuman lain yang juga dapat membuat pelaku pelangaran menjadi jera. Sebab, yang dikehendaki dari pensyari'atan sanksi hukuman (had) adalah untuk mendukung agar tujuan dari hukum pokoknya bisa diwujudkan. Selanjutnya Allah membuka ruang untuk tobat dan beristighfar.Tetapi istighfar yang tidak diiringi dengan tobat, Allah tidak akan mengampuni dosanya lagi. Allah akan menjatuhkan azab untuknya di akherat.

Abstract

This study intends to analyze the hermeneutics of Ibn Abbas on the verses of inheritance in the Koran and their implications for the Islamic inheritance model. This research is a juridical normative study using content analysis and conceptual approaches. The results of research on Ibn Abbas's hermeneutics show that: first, daughters get a 2/3 portion if they are three or more in quantity. Second, in the case of gharawayn, the mother gets 1/3 of all inheritance not 1/3 of the remaining. Third, brothers or sisters can prevent the mother from getting 1/3 into 1/6 if they are 3 or more in quantity. Fourth, the grandfather has the same position as the father absolutely when the father died first. Fifth, the word "walad" refers to children  generally, both male and female. Sixth, kalalah is interpreted as a person who dies without having children and parents. The word "children" includes boys and girls while parents include father and grandfather. Seventh, there is no 'aul in Islamic inheritance based on the logical thought that there can be no division of inheritance exceeding the amount of the inheritance itself.
